When a person is convicted of certain federal firearms offenses they may face a mandatory minimum 15 year enhanced "Armed Career Criminal" sentence under 18 U.S.C. § 924(e). "Armed Career Criminal," designation requires the following:

The present offense of conviction is for a firearms offense listed at 18 U.S.C. § 922(g) (felon in possession of a firearm etc.)

Three prior convictions for certain firearms offenses; and/or a "violent felony;" and/or a "serious drug offense."

In addition to calling for a 15 year mandatory minimum sentence, an "Armed Career Criminal" designation greatly enhance a person's Federal Sentencing Guidelines sentence range by increasing the otherwise applicable offense level and usually elevating the person's criminal history category.

The Government bears the burden of proving that a convicted defendant is subject to an "Armed Career Criminal" sentence. As with the application of the "Career Offender" laws, this area of law is extremely complex and technical.

By way of example, the terms "Violent Felony," and "Serious Drug Offense" have specific definitions that must be met by the government before they can be satisfied. In addition, the United States Supreme Court has described a specific and limited procedure by which the government is allowed to prove such convictions apply.
