Oregon man sentenced for distributing child porn

A 56-year-old Oregon man was sentenced to 24 months in prison and 36 months of parole by a Jackson County judge on Thursday following a guilty plea to five counts of encouraging child sexual abuse in the first degree.

Those charges were based on evidence that the man had possessed and duplicated numerous images of child pornography depicting the sexual abuse of children. Police reportedly found out about the images when the man showed them to an undercover agent participating in the Southern Oregon High-Tech Crimes Task Force. Police reportedly arrested the man in March 2010 by members of the task force.

A search of the man's home turned up multiple images, though sources said that there was no evidence that the images were actually produced in Southern Oregon.

In Oregon, child pornography offenses are charged under a number of offenses, one of which is known as encouraging child sexual abuse. There are three degrees of this offense. A first degree offense in this category involves knowingly involving oneself with images depicting child sexual abuse. It is most often seen where a person downloads child pornography on the internet. A second- or third-degree offense under this offense has addition qualifications indicating a diminished knowledge or intent regarding the harm implicit in the pornographic images.

In Oregon, many sex offenses come with mandatory minimum prison sentences, and conviction of a sex offense means the offender has to register a sex offender, with some exceptions. Further, sex crimes generally can't be taken off one's record in Oregon.

The bottom line is that these are serious offenses, and those accused deserve the best possible defense.
